New contributions of the thesis
Over the past years, criminal situation of Abusing positions and/or powers while performing official duties has been complex in all areas and socio-economic fields. That leads to property damage, serious political consequences, and lacks of people's confidence in the Party and government.
The Police of investigating economic crimes and corruption has made great efforts to carry out the necessary measures to investigate serious corruption cases and arrest many offenders. Those activities have contributed to the stable social order and safety. However, beside the results achieved, the investigation of those cases still has some limitations. The percentage of unsuccessful investigation cases is high while effects of investigation activities in some departments and provinces are limited. The handling of information on crime is not consistent and effective. The interrogating the accused, witness, and other people knowing the cases has not been thoroughly conducted. Basic professional operations supporting the investigation process have not been focused and carried out effectively.
Moreover, there are still significant gaps in the research on Investigating cases of Abusing positions and/or powers while performing official duties in Vietnam. Therefore, the choosing to study the topic “Investigating cases of Abusing positions and/or powers while performing official duties delivered by the Police of investigating economic crimes and corruption” is completely urgent and practical.
The thesis is the first in-depth project in Vietnam which research comprehensively, theoretically, practically into the investigation of Abusing positions and/or powers while performing official duties. The study formulates fundamental theoretical framework on the methods for investigating this crime.
The thesis has explored criminal hallmarks of the crime of Abusing positions and/or powers while performing official duties in Vietnam, the current situation of professional investigation measures to tackle this crime, basic professional operations supporting the investigation activities, as well as the inter-agency cooperation during the investigation process.
The thesis has clarified and evaluated disadvantages and limitations of the actual situation in investigating the crime, some factors influencing the effectiveness of the investigation, and then suggest some feasible solutions to enhance the effectiveness of the investigation activities in the forthcoming time. Those solutions based on theoretical framework and practical experiments will contribute to raising the effectiveness of investigating criminal cases in general and investigating cases of Abusing positions and/or powers while performing official duties in particular.
